Legal considerations are central to the organisation and governance of data spaces, recognising regulatory compliance and contractual frameworks as legal basis, with a need to consider both cross-sectoral “horizontal” EU legislation on data sharing and mobility specific “vertical” legislation. The legal dimensions of the EMDS are key for successful data space deployment. The complexity of the applicable legal framework is evident, which points to a need for legal guidance under the EMDS.
Mobility specific building blocks and common, domain-specific building blocks
- Regulatory compliance: Assess EU legislation, member state legislation and sector specific legislation to ensure compliance and facilitate data sharing.
- Roles and responsibilities: Establish clear roles and responsibilities in the EMDS, incorporating EU legal definitions to improve clarity and compliance, including terms from the Data Governance Act and the Data Act.
- Template contracts: Leverage existing work on data contracts to offer contract templates, providing a structured framework for participants to define data sharing terms, supporting legal clarity, and aligning with key governance principles.
- Smart contracting: Offer contract automation within the EMDS, especially smart contracts. Enhance data sharing by streamlining and improving contract processes.
